Likely extension of the Community Look-back period extended to July 1, 2021

Because the Public Health Emergency due to the Pandemic was extended the State Department of Health on January 21, 2021, the look-back period for Community Medicaid has likely been extended to July 1, 2021.

• The State Dept of Health unofficially informed the NYS Bar Association today that the new "lookback" is not likely to be implemented until July 1, 2021.  This is because of protections enacted under the FFCRA Families First Cares Act,  which prohibits states from  restricting eligibility until the quarter following the end of the Public Health Emergency (PHE).  The Public Health Emergency  was just  extended  on Jan. 21, 2021, for 3 months to April  21, 2021.   Therefore, NYS cannot begin requiring the lookback and imposing transfer penalties until the following quarter, which begins July 1, 2021.
• Once the lookback is implemented, assets transferred since Oct. 1, 2020 will still be subject to the lookback.   If the extension to July 1st is confirmed,  if someone transferred assets after Oct. 1, 2020, they have extra time until July 1, 2021 to submit an application seeking eligibility for home care or the Assisted Living Program, with no lookback or transfer penalty.  Check back to this website for news to see if this extension is confirmed.
